EU Deforestation Regulation (EUDR) to be postponed again
The EU Parliament and Council agree: The EU Deforestation Regulation is to be postponed by one year. If the EU Commission also gives its final approval, the amending regulation can be adopted and published later this year, so that the EUDR will not enter into force until December 30, 2026.
To combat climate change and the loss of biodiversity, the EU aims to prevent the unregulated clearing of forests. The EUDR Regulation 2023/1115 adopted for this purpose governs the provision as well as the export and import of raw materials and products such as cattle, cocoa, coffee, oil palm, rubber, soy, and timber that are associated with forest degradation.
The EUDR therefore obliges companies to prove that the above-mentioned products were not produced on land that was deforested after December 31, 2020, that production complies with the legal requirements of the country of origin, and that a due diligence statement is available.
Originally, the EUDR was scheduled to apply from the end of 2024, but the technical and practical prerequisites for legally secure implementation were not yet in place. Following protests from industry, the EU Commission postponed the start date by twelve months. In the meantime, there is a consensus between the EU Commission, the European Council, and the EU Parliament regarding a further postponement until December 30, 2026.
Planned changes
The following changes were adopted by the European Parliament on November 26, 2025:
- All companies will receive an additional year for implementation.
- For large market participants and traders, obligations will apply from December 30, 2026.
- Micro and small enterprises: obligations will apply from June 30, 2027.
- Due diligence statements must only be submitted by the first placers on the EU market.
- For small primary operators, a one-time simplified declaration is planned.
- By April 30, 2026, a “simplification review” of the EUDR is to take place.
Important restriction
Strictly speaking, the law has not yet changed.
Until the amending regulation is adopted and published, the statutory application dates of December 30, 2025 / June 30, 2026 remain in force. Companies should therefore continue their preparations but can reasonably assume that application will be postponed by one year, provided the institutions complete the process in December.
What does this mean for DACHSER customers?
The previous processes for submitting the due diligence statement remain in place until the postponement is officially confirmed. We recommend not interrupting preparations to ensure smooth operations.
